Solivita Real Estate - Solivita kept my Deposit of $38,000 for doing nothing!!!

BUYER BEWARE:We put a $33,000 deposit down on a lot, and a spec.home.

In order to hold the lot we signed a contract. Our daughter was diagnosed with a serious condition which would require that she live at home for an unpredictable amount of time. There is a 55+ condition that states anyone under that age can only live in the home for 1 month. We immediately contacted the Sales Manager to explained the situation.

We THOUGHT that they would understand and since NO WORK or even PERMITTING had begun we requested a partial refund and to be allowed to withdraw. Their reaction was "Sorry for your daughters situation, but clause 15 does not allow you to withdraw without your being in DEFAULT at which time your deposit iS NON REFUNDABLE." We find ourselves with a very sick young adult child, our life savings has been taken from us by the Management of SOLIVITA. We have hired an attorney who says this type of scam is happening to retirees all over. These conpanies write the contract , force you to sign in order to hold you place, and have made the contracts totally in their favor.

I am in hopes that the government will step in to help the millions of baby boomer who are retiring and are easy prey for this type of baiting that is going on.Do NOT trust these people.

Only one person has to be over 55, though all residents must be over 18, so there was no reason why you couldn't have proceeded with the sale. Sounds like you are either a fool who didn't do any research or were trying to scam the place after you changed your mind. Hardly the builder's fault.

I am a resident and your facts are incorrect.There are many ADULT children here residing with their parents for a number of reasons...handicaps, divorces, unemployment, etc...

No one UNDER 18 can reside in home over 30 days...over 18, not a issue.

Get your facts straight.This is a wonderful place to live.

Children 18 & over can live with their parents in Solivita as long as they want.

The only restriction is under 18.

So sorry to hear about your daughter's illness.I pray for her speedy recovery!

My husband and I have been delighted residents of Solivita over ten years. It is a wonderful place to live! What you've stated about the age restriction is NOT true. At least one person in the household must be 55 or better.

No one UNDER 18 YEARS OLD may live with you over one month per year. If your daughter is over 18, she may live with you permanently.

Many Solivita neighbors (some to their dismay) have adult children living with them full-time.I wish you and your family all the best!!

If your daughter is over 18 she can live in the home with you in SOlivita for as long as she needs.The one-month restriction applies to persons under 18.

Your Realtor can assist you with this misunderstanding.You don't need to lose the deposit.
